GDPR & Cookie Policy Statement

NaturHigia respects your privacy and we thank you in advance for your trust in us and in the products we have been marketing since 2012.
As of May 25, 2018, the General Regulation on Data Protection (EU) 2016/679 - GDPR - has been implemented in all countries of the European Union.

Below we describe everything that we consider important so that our Customers and visitors feel confident and safe when they visit us.

NaturHigia, Lda., legal person with the Tax number PT510364080, online store with the address https://www.naturhigia.pt and physical store in Rua Luís Vaz de Camões, Mercado da Brandoa, Loja 4, 2650-197 Encosta do Sol , Amadora - Portugal, is dedicated to the sale of food supplements and other products in the area of health, wellness and beauty.

NaturHigia, as the person responsible for the processing of personal data within the scope of GDPR, has appointed a Data Protection Officer (DPO), which can be contacted at any time by the email suporte@naturhigia.pt.

To what end do we use your personal data?
• For the Management of Customers - The processing of personal data is necessary for Naturhigia to be able to provide the service of sale and delivery of the products ordered by its Customers, namely, name, address, telephone, email and taxpayer number (optional).
• For Marketing Purposes - Naturhigia uses partial personal data (email and mobile phone number) - freely provided by its Customers and visitors for promotional purposes and information about its products and articles.
The use of this data will only be possible if the express consent of the holder is given for this, namely, at the moment of subscribing to the Naturhigia newsletter or at the time of registering on the site.

If you consent, you will receive information via email, about general information and/or related to your profile. The personal data used for marketing purposes are email and mobile phone. Consent for the use of personal data for marketing purposes may be revoked at any time.

With whom do we share personal data?
Personal data for the management of Customers are shared with third parties providing services, namely:
• With the transport companies contracted by NaturHigia to send the orders.
• With the entities participating in the various forms of payment available on NaturHigia - Paypal, IFThen and CGD.
• With the company that provides the technology of online chat in the site - Tawk.

Personal data for Marketing purposes are not shared with any entity outside of NaturHigia, except when creating audiences for advertising campaigns on social networks and on search engines such as Google.

What are the rights to personal data?
Right of Access and Rectification - At any time you can access your Customer information in your Customer Area and make any changes that you think need to be made.

Exclusion of Data or Right to be forgotten - This right may be exercised when personal data are no longer necessary for the purpose for which it was collected or processed, when the holder withdraws the consent and when the holder opposes the treatment of the data.
In any of these cases, provided that, for legal reasons, NaturHigia does not have to maintain them.

In order to erase or limit the use of your personal data you should contact NaturHigia at the above e-mail address (DPO).
Each request must be made only by the holder and will be dealt with on a case-by-case basis.
NaturHigia informs that it always has the right to submit a complaint to the National Commission for Data Protection (www.cnpd.pt).

The cancellation of the data for Marketing purposes can still be done autonomously in any Newsletter sent by NaturHigia through the link "Cancel Subscription".

Right to Limitation of Treatment - When the proprietor disputes the accuracy of personal data, when NaturHigia is legally responsible for processing the data, but the data subject opposes the deletion and requests the limitation of its use, whereas for NaturHigia the data are no longer required for treatment purposes but the holder requests them for the purposes of declaration, exercise or defense in a legal proceeding and, lastly, when the holder objects to the processing of the data but due to legitimate reasons on the part of the prevail over those of the holder.

Portability Right - When treatment depends on the consent of the holder, the holder has the right to receive the personal data that concern him and which have been provided to NaturHigia.

Right of Opposition - When personal data are used for the purposes of the interests of NaturHigia, for Marketing purposes and for the definition of profiles.

Personal data is stored until requested otherwise.

We request that you periodically review this GDPR Policy as it may be updated at any time.

Cookies
What are Cookies and what are they used for?
Cookies are data files automatically transferred from a Website to the hard drive of your computer.
Later, returning again to the Website, the browser you are using sends back to the server the Cookies belonging to the Website.
This allows the Website to present the information correctly set to your needs and saved settings.

Cookies help the Website to remember information about your visit, such as your preferred language, your shopping cart, browser identification or device you are using and other settings. Terms & Conditions

When ordering, you certify that you are at least 18 years of age.

By purchasing on this website the Costumer agrees to the Terms and Conditions described therein.

NaturHigia may review, update and change these Terms and Conditions at any time.

Your use, on a timely or continuous basis, means that you agree to all changes made.

NaturHigia reserves the right to cancel, in the appropriate circumstances, all Customer accounts that violate these Terms and Conditions.

1. Contacts and Customer Support
For more information, you can contact NaturHigia through our contact form, online support application or, if you prefer, you can do it by phone using the schedule and contacts provided in the footer of this site.

2. Commercial Policy
2.1. The images presented on the website are merely illustrative, so we recommend that you consult the product description for better information about the respective characteristics of the products you want to purchase.
2.2. Prices and product specifications are subject to change without notice. Despite our extreme attention to keep all the information updated, some products may contain an incorrect price, so we will check the prices whenever we process the orders.
2.3. The validation of the order request assumes that the Customer is aware and has accepted the Terms and Conditions of the site.

3. Obligations of Customers and Users
3.1. Any visitor undertakes to comply with and abide by these Terms and Conditions, in particular by observing the following obligations:
• Save, and not disclose, your password to enter the site in order to prevent third parties from accessing your account and personal data unduly;
• Do not use false identities;
• Grant your personal data and correct addresses so that NaturHigia can process the orders properly;
3.2. The Customer is solely responsible for the accuracy of the personal data communicated to us and undertakes to immediately update any changes through its Customer Account.
3.3. NaturHigia disclaims any responsibility for any delay or impossibility of processing the order due to error or insufficiency of the data communicated by the Customer, namely at the time of delivery.

4. Order Confirmation
4.1. To place an order the Customer must have a valid and frequently used e-mail account that registers or not (Buy as a Guest) as a Customer by filling in the form available online. Once registered, simply add to the virtual shopping basket all the products you want to purchase, following all the steps of the purchase so that it is completed successfully.
4.2. As soon as you complete your purchase, you will receive an automatic email confirming the transaction. In case the data is not correct you can ask immediately for its change, or even, the cancellation of the purchase made.
4.3. In case of non-confirmation of the timely payment or non-compliance with these Terms and Conditions, NaturHigia reserves the right not to accept your order, or to cancel it in whole or in part, even after automatic confirmation of the order.

5. Product availability and order confirmation/cancellation
5.1. NaturHigia only processes the order made after confirming its payment.
5.2. The information on the availability of the products refers to the moment the Customer makes the purchase. Only after confirmation of payment will the final validation of stock availability be made. It is therefore advisable to pay immediately after the order is placed.
5.3. Satisfaction of all orders placed on the site is subject to availability of the products. NaturHigia reserves the right not to accept any orders or cancel orders already confirmed for products that are no longer in stock. In case of unavailability of the product and/or stock breach, NaturHigia will inform the Customer immediately of the partial or total cancellation of its order, in which it will be entitled to reimbursement of the respective amount paid.
5.4. NaturHigia only dispatches orders on weekdays. The estimated shipping time varies depending on the carrier and the destination of your order. Any delay in the dispatch of articles, in view of the estimated dates presented, does not confer the right to compensation. Please refer to our Shipping and Returns section.

6. Confirmation or cancellation of orders
6.1. NaturHigia will cancel the orders when you do not make the payment within the stipulated period, when the order is incomplete or incorrect or when the ordered products are no longer available. In any of the above cases, NaturHigia will inform via e-mail to the Customer that the sales contract was not made and that it was not possible to proceed with the sale, specifying the reasons for doing so.
6.2. If an order has been placed and payment for products that have become unavailable, NaturHigia will refund the amount paid for the unavailable items.

7. Payment Conditions
7.1. In case of payment by bank transfer you must always indicate the reference of your order. We are not responsible for any delay due to the difficulty of validating the payment for lack of this information. In cases where it is not possible to indicate the reference (eg transfer made in ATM) please contact us indicating the name of the account holder from which you made the payment.
7.2. We will only begin processing the order after we have received payment for it. If payment of the order is not made within 2 business days, subsequent to the completion of the order, the order will be canceled.

8. Prices
8.1. The prices of products displayed on the site include Value Added Tax (VAT).
8.2. The shipping costs will be supported by the Customer and the values indicated at the time of ordering.
8.3. The prices are all set in Euros and any change in the country of delivery of the order may have influence on the prices due to the transportation costs.

9. Preparation and Delivery of Orders
9.1. After registering your order, and confirming the payment, the order is in the processing stage. This phase takes an average of 1 business day, with all products in your order being available.
9.2. Once the processing phase is completed, NaturHigia will send you the delivery deadlines described in the Shipping and Returns section of this website.
9.3. NaturHigia shall not be liable for non-compliance, or delay in complying with, any obligation to send due to an event of force majeure, that is, due to an event, act or omission, beyond its reasonable control.
9.4. NaturHigia is completly absent to the customs procedures that can be applied in the country of destination. These procedures can lead to considerable delays in the delivery of orders, it is the responsibility of the Customer to check with the local authorities the import conditions.
9.5. Delivery of orders takes place when the Customer acquires control or physical possession of the goods.
9.6. When NaturHigia sends the goods to the Customer, the risk of loss or damage of the goods is transferred to the consumer when the latter or a third party appointed by him, other than the carrier, acquires the physical possession of the goods.
9.7. At the time of delivery, the Customer must inspect the packaging and the products sent for damage. If it is found that the products are damaged, the Customer should not accept the delivery of the order, which should be returned. NaturHigia will reimburse the amounts paid for the order and the transport as soon as, at its headquarters, it receives and completes the return process.
9.8. In case the order is not delivered to the Customer for reasons other than us (eg wrong address, absence of the recipient, failure to pick up the order in good time at the Post Office or other collection point, ...) re-shipping will have an adicional cost of €5 for Portugal Continental, for the remaining destinations the value will be calculated case by case.
9.9. In international shipments, NaturHigia will not be responsible if the order is lost, lost, damaged or delayed as a result of insufficient or incorrect address, act or omission of any customs, judicial, police or fiscal, airlines, airports or other authorities of the country of destination.

10. Validity of promotions or commercial campaigns
10.1. Promotional offers or commercial campaigns advertised on the online store are valid only for the moment they are displayed on the site and according to the conditions established, unless otherwise communicated on the website.
10.2. In the case of return or exchange of items purchased in the scope of Commercial Campaigns or Promotions, you will be credited or delivered only the amount you actually spent on the purchase of the product you intend to return or exchange.

11. Responsibility
11.1. NaturHigia can not be held liable for damages suffered by third parties resulting from the use of any of our products. NaturHigia can not be held liable for damages incurred to the Customer as a result of improper use of our products.
11.2. All products marketed by us are in compliance with Portuguese and Community legislation.
11.3. NaturHigia declines all responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the Customer to verify with the local authorities the conditions of importation or use of the products that he intends to order.
11.4. NaturHigia is not responsible for the decisions made by customs / customs at the time of checking the objects subject to customs control. The Customer will be responsible for these services to unblock the situation. If any product does not arrive at the buyer, by means of a customs decision, NaturHigia disclaims any liability, and no refund will be made.

12. Links to other websites
12.1. Our website may contain links to third party websites that are not owned or controlled by us.
12.2. NaturHigia has no control or responsibility for the content, privacy policies or practices of third-party websites. You further acknowledge and agree that NaturHigia shall not be liable, directly or indirectly, for any damage or loss caused or allegedly caused or related to the use or dependence of such content, goods or services available on or through such websites.
12.3. Access to and use of the website www.naturhigia.pt is subject to your acceptance and compliance with these Terms and Conditions. These Terms apply to all visitors, users and others accessing or using the Website.
12.4. By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you do not agree to any part of the terms, then you should not navigate the same.

13. Book of Complaints
13.1. NaturHigia has a complaints book in the physical store. If you wish to file a complaint, you should address it at Rua Luís Vaz de Camões, Mercado da Brandoa, Loja 4. 2650-197 Encosta do Sol, Portugal.

14. Applicable law
14.1. In the event of a dispute regarding the interpretation or execution of these Terms and Conditions, NaturHigia and the Customer undertake to obtain a fair and adequate solution within a maximum period of 60 (sixty) days from receipt communication to that effect by any of the parties involved.
14.2. In the absence of a friendly settlement, the terms of this agreement shall be governed by Portuguese law, which shall at any time determine the forum competent to address all matters arising from this Agreement that can not be settled by common agreement between the parties.

Shipping & Returns

Shipping & Returns

• The shipping costs are calculated automatically by our website.

Occasionally, NaturHigia creates campaigns for free shipping or discounts through discount coupons and we suggest subscribing to our Newsletter.

• All orders placed until 12H noon will be sent on the same business day. Orders placed after 12H noon will be shipped the next business day.

• All orders, regardless of the payment method chosen, will only be dispatched after the payment confirmation of them.

• Normally all orders will be delivered between Monday and Friday.

• We do not ship with a weight of more than 2 kg.

• The invoice for your purchase will be sent together with the order for customs and / or tax purposes so we advise you to enter your VAT number in the section of your Customer data.

Shipping by Carrier
In the case of transport being carried out by carrier the orders will be delivered between 1 to 2 business days for Portugal Continental and 3 to 5 business days for the Archipelagos and Islands. This shipping method is not available for Overseas shipments.

Shipping by Post Office (CTT)
In the case of shipment by CTT (registered or green mail), orders will be delivered between:
• In Continental Portugal, between 1 and 5 working days;
• In the Madeira Archipelago and the Azores, between 5 and 10 working days;
• In the European Union (except Portugal), 5-10 business days. (registered mail only);
• Rest of the World, approximately 12 business days (does not include time due to customs procedures and/or other logistics procedures in destination countries).

If you are not present at the time of delivery of the order, you will be left with a notification to proceed with the collection of the order at the nearest Post Office station of the designated shipping address. The orders must be lifted up to 5 working days after the delivery attempt at the home, having to present your ID card for the collection of the same.

Pickup at Store
If you have chosen this method, you should go to the physical store to pick up your order only and only after being notified by e-mail or any other form of contact (by phone or sms). Usually delivery is possible on the day of order, unless out of stock.

Returns
You can return your order 14 business days after receipt of the product (s) (according to Article 6 of Decree-Law No. 143/2001 of April 26), after purchase.

However, you must comply with the following conditions:
• We do not accept the exchange or return of damaged products that havent been previously communicated to the carrier. At the time of delivery, you should inspect the packaging and the products shipped for damage. If you find that the products are damaged, you must not accept the order delivery, which must be returned.

• The return of the product (s) will only be accepted if they are returned in the same conditions as the sale, with the original and complete packaging, without damages or opening signals, adding the invoice and all the offers sent. No refunds will be made for material that has been tampered with or damaged by the Customer or where the Customer has not previously contacted NaturHigia. The costs of returning the products are the responsibility of the Customer.

• Returns must be made by registered mail to the address of the physical store of NaturHigia, located at Rua Luis Vaz de Camões, Brandoa Market, Loja 4. 2650-197 Encosta do Sol, Portugal.

• If the product presents a defect of transport, the entity responsible for transportation will be held responsible under the law.

• After receiving all or part of the ordered products at our premises, we will process them within an average of one week. In case the return is confirmed, you will be refunded the amount paid. Shipping costs are not refunded.

• Whenever there is exchange or return of products, whose shipping costs have been supported by us, will be deducted from the amount to be returned €5 relating to the logistical expenses incurred by us.

• Whenever there is a return of products paid by Paypal or Multibanco, the respective fee will be deducted from the amount to be refunded.

In accordance with point c) of Article 7 of Decree-Law no. 143/2001, of April 26, products that fall into the following categories are not liable to be returned:
• Dermocosmetic;
• Food suplements;
• Child and adapted nutrition;
• Medical devices;

Cancellation of Orders
All orders whose payment has not been made successfully for payment methods by Bank Transfer, ATM or PayPal will be canceled after two working days.

Prior to shipment, Customer may cancel the order of products. If the Customer places an order and intends to cancel it, he must first check the status of the order through the "Order History" menu, if the order status does not mention "Sent", then there is the possibility of canceling the order . For this, the Customer should contact us through our contact form and request the order cancellation.

If the cancellation request is successful, the Customer will be notified by email of this decision and the cancellation will be processed.

If the cancellation request is not possible because the order has already been shipped, the products will be sent to the Customer who, should he maintain his intention to cancel the order, he must refuse to receive the order by activating the return mechanism in the online store.

Upon confirmation of return and receipt of the order, the refund will be processed. Shipping costs are not refunded. If the shipping costs have been supported by us, you will be charged €5 for shipping and handling charges.

Whenever there is a cancellation of orders or return of products paid by Paypal or Multibanco, the user fee will be discounted at the amount to be refunded.
